چکیده
ریسک، بخش جداناپذیر معاملات مالی است. در گذر زمان، طیف وسیعی از ابزارهای ساده و پیچیده نظیر مشتقات برای پوشش و مدیریت ریسک خلق شده است. مشتقات به طور خلاصه ابزارها یا داراییهای مالی هستند که ارزش آنها از ارزش دارایی زیربنا مشتق شده است و در بازارهای مالی جهان برای مقاصد مختلفی از قبیل پوشش ریسک، سفتهبازی و آربیتراژ مورد استفاده قرار میگیرند.
در دهه اخیر، مشتقات مالی به دلیل اهمیت و پیچیدگی های خاص خود و پیشگامی در صنعت بانکداری مورد توجه محققان مالی اسلامی قرار گرفته است. با وجود نقش و اهمیتی که مشتقات مالی متداول در اقتصاد و بانکداری متعارف دارند اما همه این ابزارها و محصولات انطباق زیادی با قواعد اسلامی ندارند. با این حال، به منظور پاسخگویی به نیازهای نوین و رو به رشد بازار، برخی از کشورها و مؤسسات مالی اسلامی سعی کردهاند تا با استخراج منطق درونی حقوق اسلامی و بهرهگیری از فقه پویای اسلامی و کمک مهندسان مالی، زمینه طراحی و معرفی ابزارها و محصولات مشتقه اسلامی را برای مقاصد پوشش ریسک فراهم آورند.
در این مقاله، مبانی فکری و تجربههای عملی ابزارها و محصولات نوین بانکداری اسلامی در زمینه مشتقات مالی اسلامی مورد بحث و بررسی قرار میگیرد. گرچه اعتبار و استفاده از همه ابزارهای نوین مشتقه اسلامی مورد اتفاق نظر اکثریت مکاتب فکری و فقهای اسلامی نیست و حتی در برخی موارد مخالفتهای صریح وجود دارد، لیکن بررسی و آگاهی از تجارب سایر کشورها و مؤسسات اسلامی در زمینه خلق محصولات و ابزارهای نوین مشتقه اسلامی میتواند به ایجاد زمینه لازم برای تفکر و اخذ تجارب احسن کمک کند.

Risk is an inseparable part of financial transactions. During the course of time, a wide range of simple and complicated instruments like derivations for covering and management have been created. In sum, derivations are financial possessions or instruments whose value is derived from the fundamental assets, and are used in global financial markets for a variety of goals like hedging, and arbitrage.
In the recent decade, due to their importance and complexity, financial derivations have won the attention of financial researchers. Despite of their special role, importance, and leadership in current economy and banking industry, current financial derivations are not in accordance with Islamic rules perfectly. However, for the sake of accountability to the developing and modern needs of the market, some of the Islamic countries and financial institutions have made attempts to develop the internal logic of Islamic law, and make use of the dynamic Islamic jurisprudence and financial engineers' assistance to provide opportunities for designing and introducing instruments and Islamic products for hedging.
This article deals with philosophy and practical experiences of the instruments and new products of Islamic banking in Islamic financial derivations. Although the majority of schools of thought and Islamic jurists do not agree over the use of all these recent Islamic derived instruments and even in some cases there are serious disagreement and explicit oppositions. Nontheless, discussing and awareness of other countries' and Islamic institutes' experiences in the creation of new Islamic derived instruments and products can be beneficial to the process of contemplation and obtaining of the best possible experience.
